Mobile Bar Hire – Terms and Conditions

  1. Company Details

UK Base Containers, operated by UK Base Construction Ltd (“the Company”), supplies mobile bar units and associated equipment for hire throughout the United Kingdom.

Throughout these Terms and Conditions:

Company means UK Base Containers / UK Base Construction Ltd.

Hirer means the individual, organisation, company, event organiser or other party entering into the hire agreement.

Equipment means the mobile bar unit, container structure, counters, fixtures, fittings, lighting, refrigeration equipment, dispense systems, furniture and any ancillary equipment supplied by the Company.

Hire Period means the period commencing upon delivery and ending upon collection of the Equipment.

  1. Hire Period & Pricing

The minimum hire period is five (5) days unless otherwise agreed in writing.

All prices are exclusive of VAT unless otherwise stated.

Delivery, collection, lifting equipment, cranes, specialist transport, waiting time and additional site attendance are charged separately.

  1. Booking & Payment

A booking shall only be deemed confirmed once:

  • A completed booking form has been received; and
  • The required booking deposit has been paid.

A non-refundable deposit of between 25% and 50% of the total hire value is required to secure the booking.

The remaining balance must be paid no later than fourteen (14) days prior to the hire commencement date unless otherwise agreed in writing.

Bookings made within fourteen (14) days of the hire commencement date require full payment at the time of booking.

The Company reserves the right to cancel any booking where payment has not been received by the due date.

Any overdue invoices may be subject to interest and recovery costs pursuant to the Late Payment of Commercial Debts (Interest) Act 1998.

  1. Damage Deposit

A refundable damage deposit of £500.00 shall be payable prior to delivery.

The damage deposit shall be returned within seven (7) days following collection and inspection of the Equipment, subject to no damage, loss, theft or outstanding charges being identified.

The Company reserves the right to deduct from the deposit any costs incurred as a result of:

  • Damage to the Equipment;
  • Loss or theft of Equipment;
  • Excessive cleaning requirements;
  • Missing items;
  • Unauthorised alterations or modifications.

Where costs exceed the deposit value, the Hirer shall remain liable for the balance.

  1. Delivery & Collection

Delivery and collection charges are not included within the hire rates.

Charges will be calculated based upon:

  • Distance to site;
  • Vehicle access requirements;
  • Site restrictions;
  • Waiting time;
  • Craneage or specialist lifting requirements;
  • Additional labour requirements.

The Hirer shall ensure that adequate access is available for delivery and collection vehicles.

If delivery or collection cannot be completed due to:

  • Restricted access;
  • Unsuitable ground conditions;
  • Obstructions;
  • Site closures;
  • Absence of a responsible site representative; or
  • Any other matter beyond the Company’s control,

the Company reserves the right to charge for aborted visits, waiting time, additional attendance and re-delivery costs.

  1. Site Conditions

The Hirer warrants that the delivery location is suitable for the Equipment and any associated delivery vehicles.

The Company accepts no responsibility for damage to:

  • Driveways;
  • Paving;
  • Soft landscaping;
  • Underground services;
  • Lawns;
  • Ground surfaces;

arising from delivery, positioning or collection of the Equipment.

The Hirer shall be responsible for ensuring adequate ground bearing capacity and safe access throughout the Hire Period.

  1. Power, Water & Waste

Unless otherwise agreed in writing, the Hirer shall be responsible for providing:

  • A suitable electrical supply;
  • Access to water where required;
  • Waste disposal facilities;
  • Drainage arrangements where necessary.

The Company accepts no responsibility for interruptions to service caused by inadequate or failed site services.

All electrical equipment supplied by the Company shall be Portable Appliance Tested (PAT Tested) prior to delivery.

Any electrical connection to the Equipment must be undertaken by a competent person and in accordance with current electrical regulations.

  1. Equipment Care & Security

The Hirer shall be responsible for the care, custody and security of the Equipment throughout the Hire Period.

The Equipment must not be:

  • Moved;
  • Relocated;
  • Modified;
  • Painted;
  • Drilled;
  • Welded to; or
  • Altered in any way

without prior written approval from the Company.

The Equipment must not be sub-hired, assigned or loaned to any third party.

The Hirer shall ensure the Equipment is secured when unattended and shall take all reasonable precautions against theft, vandalism and malicious damage.

The Hirer shall be liable for the full cost of repair or replacement of any damaged, lost or stolen Equipment.

  1. Insurance

The Hirer is responsible for obtaining and maintaining adequate insurance cover for the Equipment during the Hire Period.

The Company strongly recommends that the Equipment is insured against:

  • Theft;
  • Loss;
  • Accidental damage;
  • Malicious damage;
  • Public liability claims.

The Company reserves the right to request evidence of insurance prior to delivery.

  1. Licensing & Legal Compliance

The Hirer shall be solely responsible for obtaining all licences, permits and permissions required for the event, including but not limited to:

  • Temporary Event Notices (TENs);
  • Premises licences;
  • Local authority permissions;
  • Event permissions.

The Company accepts no responsibility for the Hirer’s failure to obtain the necessary permissions.

Where bar staff are provided by the Company, service may be refused to any person who appears intoxicated, disorderly or under the age of eighteen (18).

  1. Health & Safety

The Hirer shall provide a safe environment for operation of the Equipment.

Adequate space must be maintained around the Equipment to allow safe access and egress.

The Company reserves the right to suspend operations where conditions are considered unsafe.

  1. Cancellation

If the Hirer cancels a booking:

  • More than 30 days before the hire date – booking deposit retained.
  • Between 14 and 30 days before the hire date – 50% of the total hire fee payable.
  • Less than 14 days before the hire date – 100% of the total hire fee payable.

The Company reserves the right to cancel a booking due to circumstances beyond its reasonable control. In such cases, any payments received shall be refunded in full and such refund shall constitute the Company’s entire liability.

  1. Liability

The Company shall not be liable for:

  • Loss of profits;
  • Loss of revenue;
  • Business interruption;
  • Loss of opportunity;
  • Consequential losses;
  • Damage to property belonging to the Hirer or event attendees.

The Company shall not be liable for injuries, losses or damages resulting from:

  • Misuse of the Equipment;
  • Failure to follow instructions;
  • Inadequate site conditions;
  • Third-party actions;
  • Failure of services supplied by others.

Nothing within these Terms shall exclude liability for death or personal injury caused by negligence where such exclusion is prohibited by law.

  1. Indemnity

The Hirer agrees to indemnify and keep indemnified the Company against all claims, actions, proceedings, losses, costs, expenses and damages arising from:

  • The Hirer’s use of the Equipment;
  • Breach of these Terms and Conditions;
  • Negligence or acts of the Hirer, their employees, contractors, guests or attendees.
  1. Force Majeure

The Company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control including but not limited to:

  • Severe weather;
  • Flooding;
  • Fire;
  • Government restrictions;
  • Industrial disputes;
  • Road closures;
  • Power failures;
  • Fuel shortages;
  • Mechanical breakdowns;
  • Public health emergencies;
  • Acts of God.
  1. Photography & Marketing

The Company reserves the right to photograph and record the Equipment and event environment for marketing, promotional and portfolio purposes unless the Hirer requests otherwise in writing prior to the event.

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.

Any dispute arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.

  1. Acceptance

By confirming a booking, paying a deposit, signing a booking form or taking possession of the Equipment, the Hirer acknowledges that they have read, understood and accepted these Terms and Conditions.
